Overview
For some time now, there have increasingly been attempts to take legal action to combat climate change. In addition to specific legal claims, these court proceedings pursue political goals by generating public and media attention. The interactive lecture explains the different types of “climate litigation” against companies and states and outlines the legal challenges that arise in each case with regard to their prospects of success. International and domestic court proceedings from Switzerland and other countries will be analysed and discussed. In addition, the extent to which “climate litigation” affects the division of powers between the legislative and executive branches on the one hand and the judiciary on the other will be examined.
